Terms of Service

Welcome to Krebs. These Terms of Service ("Terms") are a binding legal agreement between you ("User," "you," or "your") and Kruzich Media LLC ("Krebs," "we," "us," or "our"), governing your access to and use of the Krebs mobile application (the "App").

By downloading, accessing, or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the App.

These Terms also serve as the end user license agreement ("EULA") between you and us for the App, and they incorporate the additional Apple-specific terms set out in the "Apple-Required Terms" section below. Where these Terms apply to an App obtained through the Apple App Store, they apply in place of, and are intended to satisfy, the minimum terms required by Apple for a custom EULA.

1. Eligibility

You must be at least 18 years of age to download or use the App. By using the App, you represent and warrant that you meet this age requirement and are legally able to enter into this Agreement.

2. License

We grant you a personal, non-exclusive, non-transferable, revocable, limited license to install and use the App on any Apple-branded product that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions, and strictly in accordance with these Terms. You may not:

Reproduce, modify, distribute, or create derivative works based on the App;

Reverse-engineer, decompile, disassemble, or otherwise attempt to extract the source code of the App, except to the extent that this restriction is prohibited by applicable law;

Use the App for any illegal or unauthorized purpose;

Use the App in a manner that could interfere with, disrupt, or negatively affect other users;

Transfer, redistribute, or sublicense the App, or make it available over a network where it could be used by multiple devices at the same time.

If you sell or give away your Apple device, you must remove the App from it first.

3. User Conduct

You agree to use the App only for lawful purposes. You agree not to:

Upload, post, or transmit any content that is unlawful, offensive, or harmful;

Harass, threaten, or impersonate others;

Use the App in a way that could damage, disable, or impair the App's functionality or interfere with any other party's use of the App.

4. Subscriptions and Auto-Renewal

Krebs may offer access to certain features or content through paid auto-renewable subscriptions purchased as in-app purchases through the Apple App Store.

Subscription offerings. The title, length, content, and features of each available subscription are described in the App and on the App Store at the point of purchase. We may offer subscriptions on a weekly, monthly, annual, or other recurring basis. The current offerings and any introductory or promotional pricing are those displayed in the App at the time you subscribe.

Pricing. The price of each subscription is displayed in the App and on the App Store before you complete your purchase and is confirmed at the time of purchase. Prices are stated in your local currency where available and may vary by region. We may change subscription prices from time to time; any price change will apply to billing periods that begin after the change takes effect, subject to any notice required by applicable law or by Apple.

Payment. Payment will be charged to your Apple ID account upon confirmation of purchase.

Automatic renewal. Your subscription automatically renews for the same period at the then-current price unless auto-renewal is turned off at least 24 hours before the end of the current period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period, at the price disclosed to you for that renewal.

Managing and canceling. You can manage your subscription and turn off auto-renewal at any time through your Apple ID Account Settings on your device after purchase. Turning off auto-renewal stops future charges; it does not retroactively refund the current billing period, and your access continues until the end of the period you have already paid for.

Free trials. If we offer a free trial, any unused portion of the free trial period is forfeited when you purchase a subscription, where applicable. Unless you cancel at least 24 hours before the trial ends, the trial will automatically convert to a paid subscription and your Apple ID account will be charged.

Terms and Privacy. By subscribing, you agree to these Terms and to our Privacy Policy, both of which are accessible within the App and on the App Store product page.

5. Payments, Billing, and Refunds

All purchases and subscriptions made through the App are processed by Apple, and all billing and payment functions are handled through your Apple ID account. We do not collect or store your payment card details.

Refunds, where available, are handled by Apple in accordance with the Apple Media Services Terms and Conditions. Because Apple processes these transactions, we generally cannot grant refunds directly; requests for refunds should be directed to Apple. You can request a refund through Apple at https://reportaproblem.apple.com.

6. Intellectual Property

All content, trademarks, logos, and intellectual property in the App are owned by or licensed to us and are protected by copyright and other intellectual property laws. Your use of the App does not grant you any ownership or rights in the App or its content beyond the limited license provided in Section 2.

7. No Affiliation with AAMC / Trademark Notice

Krebs is an independent study tool and is not affiliated with, sponsored by, endorsed by, or approved by the Association of American Medical Colleges ("AAMC").

MCAT® is a registered trademark of the Association of American Medical Colleges. Use of the MCAT name is for identification and descriptive purposes only.

Krebs does not provide official AAMC materials, does not claim to reproduce the MCAT exam, and does not guarantee any particular score, admission outcome, or test result. Users should consult official AAMC resources for the most current exam policies, registration information, and official preparation materials.

8. Third-Party and External Services

The App may contain links to, or enable access to, third-party websites or services and external services (collectively, "External Services"). We are not responsible for examining or evaluating the content, accuracy, terms, or privacy practices of any External Services, and we shall not be liable for any such External Services. Data displayed by the App or any External Service is for general informational purposes only and is not guaranteed by us. You agree to use External Services at your own risk and in compliance with their applicable terms. You agree not to use External Services in any manner that infringes the rights of, or to harass, abuse, stalk, threaten, or defame, any person or entity. We reserve the right to change, suspend, remove, disable, or impose access restrictions on any External Services at any time without notice or liability.

9. Termination

We reserve the right to suspend or terminate your access to the App at any time, without notice, if we believe you have violated these Terms. Upon termination, all rights granted to you under these Terms will immediately cease, and you must delete the App from your device. Termination of these Terms does not entitle you to any refund of subscription fees already paid, except as required by applicable law or by Apple's policies.

10. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, QUIET ENJOYMENT, AND NON-INFRINGEMENT. NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY US SHALL CREATE A WARRANTY.

KREBS IS PROVIDED FOR GENERAL EDUCATIONAL AND STUDY PURPOSES ONLY. WE DO NOT WARRANT OR REPRESENT THAT USE OF THE APP WILL IMPROVE YOUR MCAT SCORE, RESULT IN ADMISSION TO ANY MEDICAL SCHOOL OR ACADEMIC PROGRAM, OR ACHIEVE ANY PARTICULAR EDUCATIONAL OR TESTING OUTCOME.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES OR LIMITATIONS ON A CONSUMER'S STATUTORY RIGHTS, SO THE ABOVE EXCLUSIONS AND LIMITATIONS MAY NOT APPLY TO YOU.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY PERSONAL INJURY OR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF DATA, LOSS OF PROFITS, BUSINESS INTERRUPTION, OR OTHER DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OR INABILITY TO USE THE APP, REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW THESE LIMITATIONS, SO THEY MAY NOT APPLY TO YOU.

12. Indemnification

You agree to defend, indemnify, and hold us harmless from any claims, liabilities, damages, losses, and expenses, including legal fees, arising out of or in any way connected with your use of the App, your violation of these Terms, or your violation of any applicable law or the rights of a third party.

13. Apple-Required Terms

The following terms apply to your use of the App obtained through the Apple App Store. In the event of any conflict between this section and the rest of these Terms with respect to the App on Apple devices, this section controls as to the subject matter it addresses.

a. Acknowledgement. These Terms are concluded between you and Kruzich Media LLC only, and not with Apple Inc. ("Apple"). We, not Apple, are solely responsible for the App and its content. Apple has no obligation whatsoever to furnish any maintenance or support services with respect to the App.

b. Scope of License. The license granted to you for the App is a non-transferable license to use the App on any Apple-branded product that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.

c. Maintenance and Support. We are solely responsible for providing any maintenance and support services for the App, as specified in these Terms or as required by applicable law. You acknowledge that Apple has no obligation to furnish any maintenance and support services for the App.

d. Warranty. We are solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be our sole responsibility.

e. Product Claims. We, not Apple, are responsible for addressing any claims relating to the App or your possession and/or use of the App, including but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.

f. Intellectual Property Rights. In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, we, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

g. Legal Compliance. You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties. You also agree that you will not use the App for any purpose prohibited by U.S. law, including the development, design, manufacture, or production of nuclear, missile, or chemical or biological weapons.

h. Developer Name and Address. Any questions, complaints, or claims with respect to the App should be directed to: Kruzich Media LLC, Beaumont, California, USA, michaelkruzich93 [at] gmail.com.

i. Third-Party Terms of Agreement. You must comply with applicable third-party terms of agreement when using the App.

j. Third-Party Beneficiary. You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

14. Updates and Modifications

We may update these Terms from time to time. If we make material changes, we will notify you by updating the "Last Updated" date and, where appropriate, by providing in-app notification. Continued use of the App after changes means you accept the revised Terms.

15. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located in Riverside County, California, for any legal proceedings related to these Terms or your use of the App.
